I. Board Policy
It is the policy of the Board of Education to enable employees of Soldier Hollow Charter School to obtain leave in cases of maternity and paternity. The interest of the board is to provide reasonable leave for employees while protecting the welfare of students and the continuity of their education.
A. Birth mothers or adopted mothers may take up to their accrued number of sick days and personal days of leave immediately following the birth of a child or children. The days used will be deducted from earned sick/personal leave.
B. Additional days of leave may be taken under the Family Medical Leave (FMLA) Policy, which allows eligible employees to take up to 12 weeks of unpaid leave to care for newly born or adopted children. Days used under the provisions of II. A. (above) will count against the 12 weeks total under the Family Medical Leave Policy. If both parents work for SHCS, they are entitled to a combined total of 12 weeks leave after the birth or adoption.
C. Arrangements for a substitute during leave must be coordinated with the school administration.
D. Insurance coverage will be paid by SHCS if employee has current coverage through the end of the month in which the leave is taken. Insurance coverage will continue during any FMLA time, if the employee plans to return. If continued insurance was paid by employer and employee did not return after the Family Medical Leave, according to FMLA, the employee will reimburse the employer for the insurance coverage past the final working month.
E. When the employee returns to work, she is entitled to return to the same or equivalent job with no loss of service or other rights or privileges. Should the employee not return to work when released by her physician, she will be considered to have voluntarily terminated her employment with Soldier Hollow Charter School.
